1. Overview

This website is operated by Atomic Sillage (“Company,” “we,” “us,” or “our”). By accessing our website or purchasing from us, you agree to be bound by these Terms of Service.

If you do not agree to all terms stated herein, you may not use this website or purchase our products.

2. Product Authenticity & Brand Disclaimer

Atomic Sillage provides authentic fragrance decants sourced from legally purchased original retail bottles.

We are not affiliated with, endorsed by, sponsored by, or associated with any fragrance brand unless explicitly stated.

All trademarks, brand names, logos, and product names remain the property of their respective owners.

3. Decant Disclosure

All products sold are rebottled fragrance portions transferred from original manufacturer bottles into independent atomizers.

By purchasing from Atomic Sillage, you acknowledge and agree:

  • You are purchasing a decanted sample, not the original retail bottle

  • Bottle design, caps, sprayers, and packaging will differ from brand presentation

  • Minor cosmetic differences between batches may occur

  • Slight evaporation or minor fill variation may occur due to atomizer mechanics

  • Fragrance performance varies by individual

4. All Sales Final

Due to the hygienic and consumable nature of fragrance decants:

  • All purchases are final

  • No returns

  • No exchanges

  • No refunds based on scent preference

Returned decants cannot be resold under any circumstances.

Exceptions apply only to verified damaged or incorrect items, subject to documentation requirements.

5. Scent Satisfaction Waiver & Acknowledgment of Subjectivity

Fragrance perception is inherently subjective.

By purchasing from Atomic Sillage, you acknowledge:

  • Scent preference varies from person to person

  • Longevity, projection, and sillage vary based on skin chemistry, environment, storage, and application

  • Online reviews or third-party descriptions are subjective opinions

  • Batch variations may occur within manufacturer standards

You expressly agree that:

  • Dislike of scent profile

  • Different note perception

  • Performance expectations are not being met

  • Comparison to memory of prior bottles

do not constitute a defect, misrepresentation, or grounds for a refund, chargeback, or dispute.

All fragrance purchases are made at the customer’s voluntary discretion and risk.

6. Damaged or Incorrect Items

Claims must:

  • Be submitted within 48 hours of delivery

  • Include clear photos

  • Include a full, unedited unboxing video beginning before the shipping seal is broken

Failure to provide required documentation may result in claim denial.

7. Pricing & Order Acceptance

We reserve the right to:

  • Modify pricing at any time

  • Cancel orders suspected of fraud or abuse

  • Limit quantities

Canceled orders prior to shipment will be refunded in full.

8. Shipping & Risk of Loss

Risk of loss transfers to the customer once the package is delivered to the shipping carrier.

Atomic Sillage is not responsible for:

  • Carrier delays

  • Lost packages marked delivered

  • Stolen packages

  • Incorrect addresses entered at checkout

Customers are responsible for delivery accuracy.

9. Storage & Handling Disclaimer

Fragrances should be stored in a cool, dry environment away from direct sunlight and extreme temperatures.

Atomic Sillage is not responsible for:

  • Degradation due to improper storage

  • Heat damage after delivery

  • Leakage caused by environmental exposure

  • Changes in scent due to oxidation over time

10. No Resale or Redistribution

Products purchased from Atomic Sillage are intended for personal use only.

Commercial resale, redistribution, relabeling, or repackaging without written consent is strictly prohibited.

We reserve the right to refuse service to customers suspected of unauthorized resale.

11. Fraud Prevention & Chargeback Protection

We utilize fraud detection systems and transaction monitoring.

You agree not to initiate a chargeback without first contacting:

Fraudulent or abusive chargebacks may result in:

  • Account termination

  • Refusal of future service

  • Submission of documentation to financial institutions

We reserve the right to defend disputes using tracking confirmation, fraud screening results, and communication records.

12. Intellectual Property

All content, including branding, logos, product descriptions, text, images, and graphics, is the property of Atomic Sillage and may not be reproduced without written consent.

13. Limitation of Liability

To the fullest extent permitted by law:

  • Liability shall not exceed the amount paid for the product in dispute

  • We are not liable for indirect, incidental, consequential, or punitive damages

  • We are not responsible for allergic reactions or sensitivities

Customers assume all risk associated with fragrance use.

Dispute Resolution & Arbitration

14. Informal Resolution Requirement

Before arbitration or legal action, you must contact:

Provide:

  • Full name

  • Order number

  • Detailed description of the dispute

Both parties agree to attempt an informal resolution for 30 days.

15. Binding Individual Arbitration

Any dispute relating to purchases, website use, privacy matters, or these Terms shall be resolved exclusively through binding individual arbitration under the rules of the American Arbitration Association (AAA) or a comparable provider.

16. Class Action Waiver

You waive the right to:

  • Participate in a class action

  • Join consolidated proceedings

  • Act as a representative plaintiff

All claims must be brought individually.

17. Governing Law

These Terms shall be governed by the laws of the State in which Atomic Sillage operates.

18. Exclusive Venue (If Arbitration Is Unenforceable)

If arbitration is found unenforceable, disputes shall be brought exclusively in state or federal courts located in the governing state.

You consent to jurisdiction in those courts.

19. Severability

If any provision is deemed unenforceable, remaining provisions remain valid.

20. Changes to Terms

We reserve the right to update these Terms at any time.

Continued use of the website constitutes acceptance of revised Terms.
